Since 2020, the use of certified technical security equipment (TSE) to secure records in cash registers has been required by law in Germany. The Federal Office for Information Security (BSI) has published security requirements for technical security devices and checks compliance with these certification-relevant aspects and specifications by TSE manufacturers. Compliance with the security requirements is assessed by recognized BSI test centers. If the test result is positive, the BSI certifies the TSS of a manufacturer on the basis of the test report. Once the TSE has been certified, the tax authorities must also be provided with proof that the TSE is operated by the taxpayer in such a way that the certified status is maintained. SRC has examined the fiskaly sign Cloud TSE product (version 1.2.0 – 1.0.5) from fiskaly as a BSI-recognized testing body and the BSI has issued the corresponding certificates. SRC also examined the operation of the fiskaly TSE in more detail. The operational requirements were analyzed and reviewed in close cooperation with fiskaly. The verification of compliance to maintain the certified status was carried out for all of the above-mentioned TSE versions on the market by fiskaly. The results of the audit can be summarized in the following points:
- It is proven that the fiskaly SMAERS can only accept requests from systems or components that come from the same physical operational environment.
- Communication with fiskaly SMAERS is integrity-protected and encrypted.
- It is confirmed that both A.ProtComERS and OE.SecOEnv from SMAERS PP are implemented in compliance.
- The specifications from the environmental protection concept of fiskaly considered by SRC are complied with.
- The TSE instances operated by fiskaly and examined by SRC meet the requirements for certified operation.
